The authors of a recent commentary in the Canadian Medical Association Journal underscore the immense value of Canada's health data and the accompanying sovereignty risks. They warn that when foreign companies—such as US-based tech giants Microsoft Azure, Amazon Web Services, and Google Cloud—manage encrypted health data stored in Canadian servers, the data remains susceptible to foreign jurisdictional laws. Despite physical servers being located within Canada, ownership and control can still be compromised, especially amidst concerns related to laws like the US Cloud Act, which may enable US authorities to access these data stores.
This situation echoes similar concerns across Europe, where legal frameworks seek to restrict foreign access to sensitive health data. The authors advocate for a comprehensive strategy to protect Canadian health information. Recommendations include enforcing default encryption standards, updating privacy laws to keep data within Canadian borders, preventing disclosure of health data to foreign entities, and investing in local Canadian cloud infrastructure.
By establishing robust legal and technological safeguards, Canada can both protect individual privacy and foster a secure environment for developing domestic health AI technologies. These measures would ensure that healthcare decisions are made using representative, secure data while supporting the growth of Canadian private-sector health innovation and strengthening the national health system.
